TEHG, LLC d/b/a The Eye Health Group (“TEHG”) controls this website, www.theeyehealthgroup.com (“Site”), website forms, our text messages, our e-mail marketing campaigns, and other digital advertising (collectively, our “Services”). TEHG provides management services for vision health practices (“Practices”). TEHG and the Practices identified at Locations on our webpage (collectively “we,” “us,” “our”) maintain this Privacy Policy (“Privacy Policy”). This Privacy Policy is applicable to you (“you,” “your,” or “user”).
We have developed this Privacy Policy to inform you of our practices, as well as those of our Practices, regarding the collection, maintenance, storage, use, disclosure, and protection of your information. This Privacy Policy is effective when you use the Site, when you use our Services, or WHENEVER you provide your information to us or our Practices, including but not limited to, when you provide your information in-person, online, through an online form, on the phone, in a text message, in an e-mail, through a written letter, or otherwise by some other means or manner (“Provide Information”). TEHG and our Practices obtain information about you in order to conduct business, to develop comprehensive statistics, to serve you better, and for other business-related purposes.
Information We Collect. We collect information about users of the Site, including but not limited to internet connections, computer equipment, web browsers, websites visited before and after accessing the Site, IP addresses, and other similar information about traffic and usage that does not identify an individual user, as you navigate to, through, and away from the Site (collectively “Non-Personal Information”). Third-Party Information. We also obtain information about our users from third parties, including other businesses with whom we have advertising, professional, or other business relationships. For example, when you use an online form to schedule an appointment, that form may be managed and provided by third parties who then share your information with us. Additionally, if you choose to access, visit, and/or use any third party social networking service(s) that directs you to our Site, we may receive your Personal Data and other information about you and your computer, mobile, or other device that you have made available to those social networking services. For example, some social networking services will direct you to our Site. Your decision to use a social networking service in connection with our Service is voluntary. 3. THIRD-PARTY SERVICES RELATED TO INFORMATION COLLECTION
We use third-party service providers to help us operate our Services, who may collect, store, and/or process the information detailed herein. We allow access to our database by third parties that provide us with services, such as technical maintenance and market research.
If you choose to purchase products and/or services or to make a payment on or through features on the Service(s), your Personal Information may be shared or made available to third parties for services such as credit card or other payment processing, credit pre-authorization, and address verification. There are also times when you provide information about yourself to us in areas of the Service(s) that may be managed or participated in by third parties, such as appointment scheduling. We use commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing, and use of Non-Personal Data and Personal Data. WHILE WE MAY SEEK TO REQUIRE SUCH THIRD PARTIES TO FOLLOW APPROPRIATE PRIVACY POLICIES, YOU AGREE THAT WE DO NOT BEAR ANY RESPONSIBILITY FOR ANY ACTIONS OR POLICIES OF THIRD PARTIES.

Other Third-Party Services. In addition to the applications listed above, we use other third-party services to obtain, track, and store user information. By way of example, we use a Customer Relations Management (CRM) software to manage customer data and information. Additionally, we use a third party to provide online appointment scheduling. From time to time, we may also use additional content or applications that are served by third-parties, including advertisers, ad networks and servers, social media websites, content providers, and application providers. 4. THE USE OF YOUR INFORMATION
We do not sell or rent your Personal Information. We may combine the information that we receive; for example, we may combine information we receive online with information we receive offline; and we may combine information we collect from you with information we receive from our Practices and from third parties.
We and our Practices may collect, process, and use information, including Personal Information, that we collect about users for the purpose of providing our Services, including without limitation:

  • To conduct our business operations, manage and attend to our relationship with you, and to maintain a record of our relationship, interactions, and transactions with you;

  • For the development of web statistics and user profiles and to otherwise enhance, improve, operate, maintain, and update the Services (including but not limited to, our programs and our systems);
  • To measure, assess, analyze, and review the efficacy of our advertising, the Site’ content, our services and products, and other related assessments;
  • To detect and prevent fraudulent use of the Services, or for risk management purposes, and to help maintain the safety, security, and integrity of our Services, databases and other technology assets, and business;

5. DISCLOSURE AND EXCHANGE OF INFORMATION
When you Provide Information to us or to our Practices, you are consenting to receive e-mail information, text messaging, phone call(s), or other forms of direct communications about our Services. Providing your cell number to us for contact purposes is deemed consent to be communicated with through your cell phone, including by text message. Additionally, by Providing Information, you are consenting to the release of any provided information to our Practices and/or to a third party in accordance with our HIPAA Notice of Privacy Practices and this Privacy Policy.
Unless you have specifically authorized us in writing to do so, we will never share your information with third parties for their marketing, sales, or advertising purposes, nor will we use your information to market, sell, or advertise any third-party item or service where we receive financial remuneration in exchange for making the communication.
Subject to the foregoing, we may share your information with the following parties:
  • Corporate affiliates, including corporate parents, subsidiaries, other affiliated entities, and associated entities for the purposes described in this Policy which are required to treat the information in accordance with this Privacy Policy;
  • Service providers that help us administer and provide the Services (for example, a web hosting company whose services we use to host our platform and an electronic medical records company whose services we use to maintain our records and provide online appointment scheduling). While we may seek to limit these third-party service providers’ access to your Personal Information to the purpose of performing services on our behalf, in certain circumstances (for example, where you provide your information directly to the service provider, such as when you fill out an appointment scheduling form), the use of your information may be subject to the service provider’s privacy policy;
  • Authorized third parties, who are parties directly authorized by you to receive the applicable information, such as when you authorize a third-party application provider to access your account. The use of your information by an authorized third party is subject to the third party’s privacy policy;
  • Third parties in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings);
  • As we believe necessary: (i) under applicable law; (ii) to enforce applicable terms and conditions; (iii) to protect our rights, privacy, safety or property, and/or that of our affiliates, you, or others; (iv) to detect, prevent, or otherwise address fraud, security or technical issues; (v) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment and (vi) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence; and
  • Otherwise pursuant to your express consent.

Our Service(s) may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. Such links do not constitute an endorsement by us of those other websites, their content or services, or the persons or entities associated with those websites. 9. CHILDREN’S ONLINE PRIVACY PROTECTION ACT
We do not sell products or services through our Site for purchase by anyone under the age of thirteen (13). THE SITE IS NOT INTENDED FOR OR DIRECTED AT USERS WHO ARE YOUNGER THAN THIRTEEN (13) YEARS OF AGE. If you do not meet this age requirement, you must not access or use the Site. In the event that we receive actual knowledge that we have collected Personal Information of a child under the age of thirteen (13) on our Site without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical. We reserve the right to request proof of age at any stage so that we can verify that minors are not using the Service(s). As iterated above, we reserve the right to make changes to this Privacy Policy from time to time by posting an amended version of the Privacy Policy on our Site. It is our custom to provide notification when we make material changes, which we shall do on the home page of the Site. The date that this Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring that you periodically visit our Site and this Privacy Policy to check for any changes.
